Terms and Conditions

These terms are the agreement between you and Cre8v.ai for using Scripter360. Please read them. By creating an account, downloading or using Scripter360, or buying a plan, you agree to them. If you don't agree, please don't use Scripter360.

1. Who we are

Scripter360 is made by Cre8v.ai LLC, a Wyoming limited liability company based in the United States ("Cre8v.ai", "we", "us"). "Scripter360" or "the service" means the Scripter360 desktop app for Mac and Windows, the phone and tablet apps for iPhone, iPad and Android, the website scripter360.com and the account pages, and Scripter360 AI. These terms work together with our Privacy Policy and Disclaimer.

2. Your account

• You can create an account with Apple, Google or an email address. You must verify your email address before the account can be used; until then, plans, the trial and AI are not available.
• An account is for one person. Please don't share your sign-in or let others use your account.
• Keep your information accurate and your sign-in secure. Tell us straight away at support@scripter360.com if you think someone else has used your account.
• You must be at least 13 years old (or the minimum age where you live, if higher) to use Scripter360. If you are under 18, a parent or guardian must agree to these terms for you.
• You can delete your account at any time in the app (on a computer: Settings → Account → Delete account; on a phone: ☰ → Profile → Delete Account). Deleting your account does not cancel an App Store or Google Play subscription; cancel that with Apple or Google.

3. Free trial

On a computer. After you verify your email address, you get a 14-day free trial with no payment details needed. During the trial you can create and edit as many projects as you like. You can subscribe at any time during the trial; a subscription starts, and is paid, from the day you take it. When the trial ends without a plan, you can still open, read and export your projects, but writing and new projects need a paid plan.

On a phone. Each plan in the App Store and Google Play has a 14-day free trial. You choose a plan and the store takes your payment method; you are not charged during the trial and, unless you cancel before it ends, your first payment is taken when it ends (on day 15) and the subscription then renews automatically. Store trials also follow Apple's and Google's own eligibility rules.

One free trial per person: we don't offer another Scripter360 trial to an account or email address that has already had a trial or a plan, on a computer or in the phone apps. Trials can't be extended.

AI during the trial. A trial may include a small number of AI credits to try Scripter360 AI. Whether a trial includes them, and how many, can change at any time without notice and doesn't change the rest of the trial. Trial credits end when the trial ends; unused ones don't carry over. The monthly credits of Standard + AI start with your first payment.

4. Plans and prices

• Plans. We offer Standard and Standard + AI, paid monthly or yearly. What each plan includes is shown in the app, or on our website, at the time you buy.
• Buying on our website. Website orders are processed by Paddle (Paddle.com), our reseller and merchant of record. Paddle handles the payment, sales tax or VAT, invoices and billing questions, and your purchase is also subject to Paddle's buyer terms.
• Buying in the phone apps. In-app purchases are made through the Apple App Store or Google Play and are subject to their terms.
• Prices and taxes. Prices are shown before you buy. Depending on where you live, sales tax or VAT may be added. We may change prices for future billing periods; if the price of your subscription changes, we will tell you in advance, and you can cancel before the new price applies.
• Automatic renewal. Subscriptions renew automatically at the end of each month or year, and you will be charged for the next period, until you cancel.

5. Upgrading, downgrading and cancelling

• Upgrades (for example Standard to Standard + AI, or monthly to yearly) start straight away. The unused part of what you already paid is credited against the new price (proration).
• Downgrades start at your next renewal. There is no refund of the difference.
• Cancelling turns off automatic renewal. Your plan stays active until the end of the period you paid for, and is not renewed after that. You can cancel at any time: on the website through Settings → Account → Manage subscription (Paddle), or in your Apple or Google account for store purchases.
• When a plan ends, your writing is never locked away. You can still open, read and export your projects; editing needs an active plan.

6. Refunds

The same rules are also on our Refund Policy page.

14-day money-back guarantee. If you are not happy with Scripter360, ask within 14 days and we will refund you in full.

• Website purchases (Paddle). You can get a full refund if you ask within 14 days of your first payment for a plan, or within 14 days of a yearly renewal. Write to support@scripter360.com; refunds are issued by Paddle to your original payment method. After 14 days there are no refunds for the time left in the period. Monthly renewals are not refunded. You can cancel at any time, and your plan keeps working until the end of the period you paid for. If you live in the European Union or the United Kingdom, you also have the legal right to withdraw described in Paddle's buyer terms.
• App Store and Google Play purchases. Refunds are handled by Apple or Google under their own rules. We cannot issue refunds for these purchases; please request them from Apple (reportaproblem.apple.com) or Google Play.
• AI credit packs can be refunded within 14 days of purchase if none of the pack's credits have been used.
• Nothing in this section limits any rights you have under the consumer laws where you live.

7. AI credits

• Scripter360 AI uses credits. The size of a review decides how many credits it uses; the app shows your balance.
• Standard + AI includes a monthly allowance of credits. The allowance resets at each renewal and unused credits do not carry over.
• You can buy extra AI credit packs. Credits in a pack bought on our website expire 12 months after purchase; we will remind you by email 30 days and 7 days before they expire. Credits bought in the App Store or Google Play do not expire. Your monthly allowance is used first, then packs, oldest first.
• Trial credits end when the trial ends (see section 3). Gift credits may expire sooner, as shown in the app.
• Credits have no cash value, cannot be transferred or sold, and are used only for Scripter360 AI.

8. Your licence to use the apps

• While your trial or plan is active, we give you a personal, non-exclusive, non-transferable licence to install and use Scripter360 for your own writing, personal or professional, under these terms.
• Devices. One account can be signed in on up to 3 devices at the same time — computers, phones and tablets together. To use another, sign out of one: the app offers this when you reach the limit, and you can do it any time in Settings → Account → Devices on a computer or Profile → Devices on a phone.
• Working offline. The apps work without an internet connection. They need to go online from time to time (about every 30 days) to confirm your plan. If an app cannot confirm your plan for longer than this grace period, or your plan has ended, it switches to read-only: you can open, read and export your projects, but not edit them, until it can confirm an active plan again.
• Updates. We may release updates that fix problems or change features. Some updates may be required to keep using the service, for example for security.
• Scripter360 is licensed, not sold. We and our licensors keep all rights not expressly given to you.

9. Your writing and your content

• You own what you write. We claim no ownership of your projects, documents, notes, images or anything else you create or import ("your content").
• We don't store your writing. Your content stays on your devices or in your own cloud storage. We get no licence to it, except the limited permission to process text you send to Review with AI, only to create that review for you.
• Backups are your responsibility. Scripter360 has backup and recovery tools, but you are responsible for keeping copies of your work. We cannot recover files that were deleted, lost or damaged on your device or in your cloud storage.
• Your cloud storage (such as iCloud Drive, Google Drive or Dropbox) is provided by those companies under their own terms, and we are not responsible for it.
• You are responsible for your content and for having the rights to use anything you import or send to Review with AI.

10. Review with AI

• Review with AI is optional. It sends the text you choose to an AI provider to create suggestions, as described in our Privacy Policy. If you use your own AI key, your use of that provider is also under your agreement with them.
• AI suggestions are created automatically and may be wrong, incomplete, or similar to text written by others. Review them before you use them. You decide what to accept, and you are responsible for the final text. See our Disclaimer.
• Don't use Review with AI to create content that is illegal, harmful, or that infringes other people's rights, or in a way that breaks our AI provider's usage policies.
• We may limit how much Scripter360 AI is used, to protect the service from abuse.

11. Things you must not do

• Share, resell, rent or sublicense your account or Scripter360.
• Get around the device limit, the licence check, the trial limits or credit limits, or change the date on your device to do so.
• Copy, change, decompile or reverse engineer the apps, except where the law allows it despite this restriction.
• Interfere with, overload or attack our servers, or access them other than through the apps and website.
• Use Scripter360 to break the law or other people's rights.

12. Our rights

Scripter360, its software, design, logo and name belong to Cre8v.ai and its licensors and are protected by copyright, trademark and other laws. These terms do not give you any right to use our name or logo. If you send us ideas or feedback, we may use them freely without paying you.

13. Other companies' services

Scripter360 works with services from other companies, such as Apple, Google, Paddle, OpenAI and cloud storage providers, and can export to formats used by other apps. Those services have their own terms, and we are not responsible for them, for their availability, or for changes they make.

14. Changes to Scripter360 and to these terms

We keep improving Scripter360 and may add, change or remove features. If we make a change that significantly reduces what your paid plan includes, we will tell you in advance. We may update these terms; we will change the date above and, for important changes, tell you in the app or by email before they take effect. If you keep using Scripter360 after that, the new terms apply. If you don't agree, you can cancel and stop using Scripter360.

15. Suspending or ending your account

We may suspend or end your account if you seriously or repeatedly break these terms, if we must by law, or to protect Scripter360 or other people. Where it is reasonable, we will warn you first. If we end your account without a good reason related to your conduct, we will refund the unused part of any prepaid plan. Your writing stays on your devices in any case. Sections that by their nature should continue (for example 9, 12, 16 to 19) continue after your account ends.

16. Disclaimer of warranties

Scripter360 is provided "as is" and "as available". To the fullest extent the law allows, we do not make any promises or warranties, express or implied, including that Scripter360 will be error-free or always available, or that it is fit for a particular purpose, of merchantable quality, or non-infringing. More details are in our Disclaimer. Some places don't allow these exclusions, so some may not apply to you.

17. Limitation of liability

To the fullest extent the law allows, Cre8v.ai will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or writing, arising from your use of Scripter360. Our total liability for all claims about Scripter360 is limited to the greater of the amount you paid us for Scripter360 in the 12 months before the claim, or US $50. These limits do not apply where the law does not allow them, for example for fraud, or for death or personal injury caused by negligence.

18. Indemnity

If someone brings a claim against us because of your content or because you broke these terms or the law, you agree to cover our reasonable costs and losses from that claim, to the extent the law allows. This does not apply to consumers where local law doesn't permit it.

19. Governing law and disputes

These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. Before starting any formal claim, please contact us at support@scripter360.com so we can try to solve it together. Any dispute will be decided by the state or federal courts located in Wyoming, unless the law where you live gives you the right to bring a claim in your local courts. If you live in the European Union, the United Kingdom or another country with consumer protection laws, you keep the protection of the mandatory laws of your country.

20. Apps from the Apple App Store

If you downloaded Scripter360 from the Apple App Store, these terms are between you and Cre8v.ai, not Apple. Apple is not responsible for Scripter360 or its content, and has no obligation to provide maintenance or support for it. If the app fails to meet any warranty that applies, you may notify Apple, and Apple may refund the purchase price of the app; to the extent the law allows, Apple has no other warranty obligation. Apple is not responsible for any claims about the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection or privacy claims, or claims that it infringes someone's intellectual property; we are responsible for handling those, as described in these terms. You confirm that you are not in a country under a US government embargo and are not on any US government list of restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Your use of the app must also follow the App Store's usage rules.

21. General

• These terms, the Privacy Policy and the Disclaimer are the whole agreement between you and us about Scripter360.
• If a part of these terms can't be enforced, the rest still applies.
• If we don't enforce a part of these terms straight away, we can still do so later.
• You may not transfer your rights under these terms to someone else. We may transfer ours, for example if the business is sold, and your rights will not be reduced.
• We are not responsible for delays or failures caused by events outside our reasonable control.
• These terms are written in English. Translations of headings or notes are for convenience only; the English version applies.
